Terms of Service – General Terms and Conditions

SCOPE & CONTRACTING PARTIES

These General Terms and Conditions (hereinafter referred to as "GTC") apply to all contracts for the rental of apartments and flats for accommodation purposes, concluded between Heidi Allar and Jose Codes GbR ("nice2be Apartments") and third parties ("Guest"), as well as for all related services and deliveries provided by the aforementioned company. The contracting party in Germany is Heidi Allar and Jose Codes GbR. The customer's own terms and conditions shall only apply if expressly agreed in writing in advance.

RESERVATIONS / BOOKINGS

By making a reservation or booking, the guest offers to enter into an accommodation contract. If the requested apartment is available, nice2be Apartments will send a reservation/booking confirmation. This confirmation constitutes a binding accommodation contract, subject to timely payment in accordance with the agreed payment terms. Offers by nice2be Apartments regarding available apartments are non-binding and subject to availability. nice2be Apartments reserves the right to reject accommodation contracts at its sole discretion. If the guest only books a category of apartment and not a specific unit, they have no claim to a specific apartment. Standard restrictions such as minimum stays, booking guarantees, or advance payments for certain travel dates may apply.

CANCELLATION DEADLINES / GUEST WITHDRAWAL / NO-SHOW

A reservation is considered guaranteed only upon receipt of payment by nice2be Apartments. If no right of cancellation has been agreed upon or if it has already expired, and nice2be Apartments does not consent to contract termination, the guest is obliged to pay the agreed price, even in the event of no-show or late cancellation. nice2be Apartments will deduct any income from alternative rental and saved expenses. If the apartment is not re-rented, a flat deduction of 10% for saved expenses applies, and the guest must pay 90% of the agreed accommodation price. The guest may provide proof that no or lesser damage was incurred. For multi-day reservations, all subsequent nights are cancelled after a no-show on the first night without any entitlement to the remaining stay. The guest may suggest a suitable replacement tenant. If accepted in writing, the replacement assumes all rights and obligations. A handling fee of €50.00 may apply. In this case, no cancellation fee is charged. For same-day bookings, payment must be made immediately, usually within one hour. For bookings made via platforms such as Airbnb or Booking.com, the respective cancellation policies of those platforms apply.

PRICES & OTHER FEES

The valid prices are those displayed at the time of booking. All prices include applicable taxes, charges, and fees. Local charges owed by the guest, such as visitor's tax, are not included. PAYMENT TERMS & INVOICING The accommodation fee must be paid in advance. Payment is due immediately after receipt of the booking confirmation using an accepted payment method. Proof of payment must be submitted. If payment is not confirmed within 24 hours, the booking will be released, and availability cannot be guaranteed. In all cases, payment must be received before check-in or verified if less than 48 hours remain before arrival. Offsetting is excluded unless the counterclaim is undisputed or legally established. Accepted payment methods: Sofort transfer, PayPal, or bank transfer. Cash payments are not accepted. nice2be Apartments reserves the right to charge the provided payment method for additional services or violations of the terms. The guest expressly consents. By making a reservation, the guest agrees to receive their invoice via email or download.

USE OF RESERVED APARTMENTS

A reserved apartment is available to the guest during the agreed period only. Keys, parking permits, and/or key cards must be returned on departure either to nice2be Apartments, a designated third party, or to a clearly marked drop-off location in the apartment. Loss of keys, cards, or parking permits incurs a €40.00 fee. Further damages exceeding this amount may be claimed, including replacement of lock systems if required. The guest may prove that no or lesser damage occurred. Late check-out is possible upon request and subject to availability. If agreed, €10.00 per hour is charged. Without agreement, €30.00 per hour applies. After 3 hours, a full overnight rate may be charged. Guest may prove lesser damages. There is no contractual entitlement to late check-out. Early check-in is possible on request and subject to availability. If agreed, €10.00 per hour is charged. No legal entitlement exists.

SUBLETTING & USAGE

Subletting or reselling apartment reservations is prohibited. This includes selling to third parties at a higher price. Violations may result in cancellation. Use of the apartments for purposes other than accommodation is prohibited. This includes commercial or illegal activities, as well as photo/video recordings without prior permission. In such cases, the booking may be cancelled without refund.

LIABILITY OF NICE2BE APARTMENTS

nice2be Apartments is liable without limitation for damages resulting from injury to life, body, or health. For other damages caused by gross negligence or intent, liability also applies. For slight negligence, liability is limited to foreseeable damages of essential contractual obligations. In the event of defects or disruptions, nice2be Apartments will attempt to resolve them promptly. The guest must assist in minimizing damages. nice2be Apartments is liable for items brought into the apartment according to statutory provisions. Claims expire unless reported promptly. For valuables over €800 or other items over €3,500, a written agreement is required. Providing a parking space does not constitute a safekeeping contract. Liability only arises in case of gross negligence or intent. Damage must be reported immediately. All claims expire within one year unless involving injury or gross negligence. nice2be Apartments is not liable for lost items unless caused by gross negligence or intent. Lost items will be stored for 6 months and can be returned upon request for a fee of €15. SECURITY DEPOSIT To secure its claims, nice2be Apartments may require the following deposits: Less than one month: €250 One to six months: one month’s rent For stays under three months, the deposit may be pre-authorized on the payment method. If not paid, the guest loses their right to stay. If already checked in, the provider may terminate the contract immediately. The deposit will be settled within one month after the end of stay. GUEST DATA Email and phone number are required for communication. A valid ID must be presented at check-in (ID or passport). If identity cannot be verified, the booking may be cancelled. Fraud prevention software may be used to assess risk. Bookings flagged as suspicious may be cancelled.

TERMINATION OF CONTRACT

nice2be Apartments may terminate the contract for good cause, including: Force majeure Threat to operations or reputation Misleading booking details Illegal purpose or prostitution Unauthorized reselling/subletting No compensation is owed to the guest in these cases. Future bookings may also be cancelled.

NO SMOKING POLICY

All apartments are non-smoking. Smoking is only allowed on designated balconies with closed doors. Violations result in a minimum fee of €250. Higher damages may apply. Tampering with fire safety systems or alarms incurs a €150 fee and may lead to immediate cancellation without refund. Fire alarm systems may be connected to emergency services. False alarms due to negligence are fully charged to the guest.

NO PARTIES OR GATHERINGS

Quiet hours are 10 PM to 6 AM. Parties or gatherings are strictly prohibited. Violations may result in a minimum charge of €500 for cleaning and lost revenue. Further claims may apply. Sound level sensors (not recording speech) may be installed. Public areas may also have video surveillance. Bookings may be terminated immediately without refund. Security services may be engaged at the guest’s expense.

DAMAGE OR UNAUTHORIZED

REMOVAL OF INVENTORY Guests are liable for any damage beyond normal use or missing items. A processing fee of €50 may apply. Guest may prove lesser damage. PETS Pets are not allowed. Exceptions apply for certified service animals. Proof must be submitted in advance. Unauthorized pets incur a €150 cleaning fee and may result in immediate termination without refund.

MAINTENANCE & CLEANING

Guests must treat the apartment and shared facilities with care. Heavy dirt or misuse results in a minimum €50 cleaning fee. The guest must report defects upon check-in. Guests are liable for damages caused by themselves or visitors. For stays longer than 7 nights, weekly cleanings may be carried out. Access must be granted. INTERNET USAGE Internet access is provided subject to availability. Interruptions may occur. Illegal use (e.g. file sharing, illegal streaming) is prohibited. The guest is liable for violations and indemnifies nice2be Apartments. Sharing login details is prohibited. Damages from misuse are the guest’s responsibility. nice2be Apartments may block access in case of violations. HOUSE RULES The guest accepts and agrees to comply with the house rules during the stay.

RIGHT OF ENTRY / INSPECTION

nice2be Apartments reserves the right to enter the unit with notice and for justified reasons (e.g. maintenance, meter readings, safety concerns). In emergencies, entry may occur without notice.

FINAL PROVISIONS

Amendments must be made in writing. This also applies to waiving the written form requirement. Place of performance and payment is the location of the accommodation provider. Jurisdiction is the provider’s location if applicable under German law. German law applies. UN sales law is excluded. If any provision is invalid, the remainder remains valid. An equivalent valid provision shall apply. The provider is not obligated or willing to participate in consumer dispute resolution procedures.
